In the early hours of New Year's Eve 2023, what should have been a night of celebration at Primrose Hill turned into a nightmare. Sixteen-year-old Harry Pitman was fatally stabbed after a confrontation that began when he accidentally bumped into someone, the jury at the Old Bailey has been told.
The defendant, a 17-year-old who cannot be named for legal reasons, does not deny causing Harry’s fatal injury. The trial now revolves around two key issues: whether the stabbing was an accident and whether the defendant acted in lawful self-defense.
The Incident Unfolds
Prosecutor Jocelyn Ledward KC laid out the tragic sequence of events in her opening statement on September 3rd. She explained that Primrose Hill, a popular spot for New Year's celebrations, was packed with revelers, including Harry and his friends, as well as the defendant and his group—two sets of complete strangers.
At approximately 11:30 PM, Harry, engaged in a playful game where he tried to kick as high as possible, lost his balance and bumped into one of the defendant's friends. This seemingly innocuous contact set off a chain reaction. The individual he bumped into reacted angrily, shoving Harry. Witnesses reported hearing Harry say, “Don’t touch me, because I didn’t touch you.”
The situation escalated quickly. The defendant’s friend then slapped Harry on the back of the head. A physical altercation ensued, partially captured on a 63-second video taken by a bystander.
The Fatal Stabbing
The video shows the defendant’s friend grabbing Harry by the neck and throwing punches, which Harry returned. During the scuffle, the defendant approached, holding his trousers with one hand, seemingly trying to maintain his balance or reach for something.
At around 13 seconds into the video, a female voice can be heard saying “mindi,” the Somali word for knife. The woman later told police she saw the defendant draw a knife from his waistband. As the fight continued, Harry appeared to swing a punch at the defendant, who then brought his right arm up in an arcing motion, striking down towards Harry's neck.
Witnesses described the knife as being no larger than a kitchen knife, with one noting it was “not a Zombie knife.” The knife's sheath flew off during the attack, landing near an adult witness. Harry, now mortally wounded, managed to push his way through the crowd towards a group of police officers, his shirt soaked in blood. He pleaded for help, but despite the officers’ immediate efforts, including CPR and first aid from paramedics, Harry succumbed to his injuries at 11:54 PM.
The Aftermath and Legal Proceedings
After the stabbing, the defendant fled the scene, laying low in a nearby car park before reuniting with his friends. Despite searches, the knife used in the attack has never been recovered, leading prosecutors to suggest it was likely disposed of in a bin that was emptied before police could conduct a thorough search.
The defendant initially denied involvement in the stabbing when questioned by police, but later, when confronted with video evidence, he admitted to being present and wielding the knife. However, he claims the stabbing was not intentional, and he acted out of fear for his own safety.
As the trial continues, the jury will be asked to determine whether the stabbing was a deliberate act of violence or a tragic accident during a chaotic brawl. The case will also explore the defendant's intentions and whether his actions could be considered self-defense.
The prosecution, led by Ms. Ledward, argues that the defendant deliberately targeted a vulnerable part of Harry’s body, with the intention to cause serious harm if not death.
